Under Section 123(2) of the Representation of the People Act, 1951, any direct or indirect interference or attempt to interfere with the free exercise of electoral rights by a candidate, their agent, or any other individual is considered a corrupt practice.
According to Section 171 B of the Indian Penal Code, individuals giving or accepting gratification in cash or kind during the election process to influence others’ voting decisions face imprisonment for up to one year or a fine, or both.
Similarly, under Section 171 C of the Indian Penal Code, any undue presence or threat directed at candidates or voters during the election process is punishable by imprisonment for up to one year or a fine, or both. District Control Rooms are being established to monitor adherence to the Model Code of Conduct and to swiftly address any reported violations.
